GENERAL

These terms and conditions apply to all offers, sales, and deliveries made by Eastern Gate Ltd. ("Eastern Gate"), unless otherwise agreed upon in writing. Any references by buyers to their own terms and conditions are not applicable unless expressly accepted in writing by Eastern Gate. Agreements or promises made by representatives are only binding if confirmed in writing by Eastern Gate.

PRICES AND OFFERS

Unless expressly stated otherwise, our offers and prices, whether listed in catalogs or presented on our website, are non-binding. Orders placed with our representatives or agents are binding upon confirmation in writing by Eastern Gate.

DELIVERY PERIODS

All delivery dates provided are estimates only. Eastern Gate shall not be held liable for damages or compensation resulting from delayed delivery.

DELIVERY

Goods are shipped at the buyer’s risk, even in cases where Eastern Gate covers the delivery costs.

COMPLAINTS AND LIABILITY

The buyer is responsible for inspecting the goods upon receipt to ensure they meet specifications (e.g., quantity, dimensions, materials, and finish). Any visible defects must be reported in writing within three days of receiving the goods. Complaints lodged after this period, or after the goods have been used or altered, will not be considered.

Hidden defects that become apparent within three months of receipt must be reported within eight days of discovery. In such cases, the buyer’s rights are limited to replacement of the defective goods, with no entitlement to damages or compensation. Eastern Gate’s liability for any defect is limited to the net price of the affected goods. Claims for indirect damages, including assembly costs, personal injury, or damage to other property, are expressly excluded.

PAYMENT

Unless otherwise agreed, payments must be made within 30 days of the invoice date, without any discount deduction. Payment is deemed made only when credited to our account. Late payments will incur interest at a rate of 15% per annum from the due date, applied automatically and without prior notice. In cases of non-payment, the outstanding balance will increase by a penalty of 10%, with a minimum charge of QAR 300, separate from any legal costs or interest.

If an invoice is not paid by its due date, Eastern Gate reserves the right to demand full payment of the outstanding balance on the buyer's account and to suspend or terminate any ongoing transactions. Title to the goods remains with Eastern Gate until full payment is received. In cases of default, Eastern Gate reserves the right to reclaim goods from the buyer, though all risks associated with the goods pass to the buyer upon delivery.

FORCE MAJEURE

If Eastern Gate is unable to fulfill one or more of its obligations due to circumstances beyond its control (force majeure), it reserves the right to cancel the agreement, either wholly or in part, by notifying the buyer in writing without any liability for damages.

JURISDICTION

In the event of a dispute, the courts of Qatar shall have exclusive jurisdiction. These terms are governed by the laws of Qatar.

INTELLECTUAL PROPERTY

All content on the Eastern Gate website, including text, images, logos, and data, is protected by intellectual property rights held by Eastern Gate or its licensors. Content may only be downloaded for personal, informational use. Any other use, including reproduction, distribution, or publication for commercial purposes, is prohibited without prior written consent from Eastern Gate.

WEBSITE IMAGES AND ILLUSTRATIONS

Product images, descriptions, and specifications on our website are provided for illustrative purposes only and are not binding. Eastern Gate reserves the right to modify product specifications without prior notice. While we strive to provide accurate information, errors or incomplete technical data may appear on the site. Any detected inaccuracies will be corrected as soon as possible at the discretion of Eastern Gate.
